Germany: Residence Permit Exemption for Foreign Nationals Residing in Ukraine Extended

The German government has extended the exemption for foreign nationals who were residing in Ukraine on February 24, 2022 and who enter Germany by December 4, 2027 without holding a residence permit (required for a long-term stay) from the requirement to obtain a residence permit for a period of 90 days from their first entry into Germany, provided that they have not already been granted temporary protection in another EU Member State.
Importantly, according to a new rule, the exemption will not apply to foreign nationals who enter Germany on or after October 9, 2026 and who are subject to military service obligations under Ukrainian law, unless they can demonstrate that they are complying with those obligations. As a result, affected individuals may need to provide evidence of compliance with their military obligations in order to benefit from the 90-day residence permit exemption upon entry into Germany.
